File No. 604 Comments Due: October 18, 2002 Section 214 Application Applicant: TLX Communications, Inc. d/ b/ a TelAmerica and Advanced Tel, Inc. d/ b/ a Eatel On August 28, 2002, TLX Communications, Inc. d/ b/ a TelAmerica and Advanced Tel, Inc. d/ b/ a Eatel (collectively Applicants) located at 913 South Burnside Avenue, Gonzales, Louisiana 70737- 4258 filed an application with the Federal Communications Commission (FCC or Commission), requesting authority under section 214( a) of the Communications Act of 1934, as amended 1 , to discontinue the provision of interstate long distance service to selected markets. 2 The application states that Applicants are affiliated corporations, 3 and are seeking to streamline their respective operations by discontinuing services in specified markets where there exist few or no subscribers. Applicants seek to discontinue service to residents of Arizona, California, Illinois and Indiana. 4 A letter was mailed to the fifteen affected customers of TLX 1 47 U. S. C. § 214( a). See also 47 C. F. R. § 63.71. 2 Applicants, both non- dominant international carriers, will also simultaneously discontinue the provision of international services to these markets. Applicants have taken the appropriate steps to discontinue the provision of intrastate interexchange service within the affected jurisdictions. 3 Each Applicant is ultimately owned by EATELCORP, Inc., a Louisiana corporation owned by U. S. citizens. 4 Advanced Tel, Inc. serves no customers in these states, and TLX Communications, Inc. serves only a total of 15 customers, 4 in Arizona and 11 in California. In accordance with section 63.71( c), the application will be deemed to be automatically granted on the thirty- first (31 st ) day after the release date of this notice, unless the Commission has notified Applicant that the grant will not be automatically effective. 5 The Commission will normally authorize proposed discontinuances of service unless it is shown that customers or other end users would be unable to receive service or a reasonable substitute from another carrier, or that the public convenience and necessity would be otherwise adversely affected. This proceeding is considered a “permit but disclose” proceeding for purposes of the Commission's ex parte rules. 6 Pursuant to sections 1.415 and 1.419 of the Commission's rules, interested parties may file comments on or before October 18, 2002. 7 Such comments should refer to Comp. Pol. File No. 604. Comments should include specific information about the impact of this proposed discontinuance on the commenter, including any inability to acquire reasonable substitute service.
