 By  the  Deputy  Chief,  Policy  Division,  Media  Bureau: 
 1.  On  November  6,  1998,  Marcus  Cable  Associates,  L.  P.  (“  Marcus”)  filed  with  the  Commission  an  appeal  of  a  local  rate  order  adopted  by  the  City  of  North  Richland  Hills,  TX  (“  City”)  on 
 September  14,  1998. 
 2.  On  October  4,  2002,  Marcus  filed  a  Motion  to  Withdraw  Appeal  of  Local  Rate  Order.  In  its  motion,  Marcus  states  that  it  has  reached  an  acceptable  resolution  of  this  matter  with  the  City  and 


 requests  that  the  filings  in  this  proceeding  be  dismissed  without  benefit  of  substantive  Commission  review. 


 3.  Accordingly,  IT  IS  ORDERED  that  the  Motion  to  Withdraw  Appeal  of  Local  Rate  Order  filed  by  Marcus  Cable  Associates,  L.  P.  IS  GRANTED  and  the  appeal  filed  on  November  6,  1998 
 IS  DISMISSED. 
 4.  This  action  is  taken  pursuant  to  authority  delegated  by  Section  0.283  of  the  Commission’s  rules,  47  C.  F.  R  §  0.283.
