On March 15, 2002, WWC Holding Co., Inc. (WWC) filed the above- captioned application seeking consent to calculate its cellular geographic service area (CGSA) at two existing cellular sites (Horse Creek and Chugwater) using an alternative method pursuant to section 22.911( b) of the Commission’s rules. 1 The application appeared on public notice as accepted for filing on March 20, 2002. 2 2. On April 19, 2002, Excomm, LLC (Excomm) filed a petition to deny the application. 3 In its petition, Excomm contends that the application proposes to enlarge WWC’s CGSA at the Chugwater site even though WWC does not currently provide cellular service beyond its existing CGSA at that site. Excomm argues that WWC’s proposal would deny other parties the opportunity to provide service to the area and would result in the warehousing of unserved area to the detriment of the public. In response to Excomm’s petition, WWC filed an amended application on May 23, 2002, which restored the contours at the Chugwater site to their original operating parameters. We therefore dismiss the petition as moot. 3. Accordingly, IT IS ORDERED that, pursuant to section 4( i) and 309( d) of the Communications Act of 1934, as amended, 47 U. S. C. §§ 154( i), 309( d), and sections 0.331 and 1.939 of the Commission’s rules, 47 C. F. R. § 0.331, 1.939, the petition to deny filed by Excomm, LLC on April 19, 2002, IS DISMISSED as moot.
