The Allocations Branch has before it for consideration a Petition for Reconsideration (“ Recon.”) of the Report and Order (“ R& O”), in this proceeding, 14 FCC Rcd 18890 (1999), filed by Radio Licensing, Inc. (“ RLI”), licensee of Station KJCS, Nacogdoches, Texas. 1 Thereafter, RLI filed a Request for Dismissal of its Petition for Reconsideration. 2 As requested, we shall dismiss the Petition for Reconsideration. 2. Background. The Commission issued a Notice of Proposed Rule Making in this proceeding in response to a petition filed by Wolverine Broadcasting (“ Wolverine”) requesting the allotment of Channel 274A at Centerville, Texas. Wolverine filed comment s in response to the Not ice request ing the allotment of Channel 278A in lieu of Channel 274A. Since no other comments were received in response to the Notice and Wolverine stated its intention to file an application for Channel 278A, action in the Report and Order allotted Channel 278A to Centerville. 3. On December 17, 2001, Radio Licensing, Inc. filed a Request for Dismissal of its Petition for Reconsideration. Radio Licensing, Inc. filed an affidavit stating that no consideration has been paid or received in connection with its decision to dismiss the Petition for Reconsideration filed in this proceeding. 1 Public notice of the Petition for Reconsideration was given on September 1, 2000, Report No. 2435. 2 The license for Station KJCS, Nacogdoches, was modified in MM Docket No. 01- 31 to specify operation on Channel 277C2 in lieu of Channel 277C1.
