L. C. AND WCI CABLE, INC. TO NEPTUNE COMMMUNICATIONS CC Docket No. 02- 51 Pursuant to section 214 of the Communications Act of 1934, as amended, 47 U. S. C. § 214, and sections 0.91, 0.291, and 63.01 of the Commission’s rules, 47 C. F. R. §§ 0.91, 0.291, and 63.01, the Wireline Competition Bureau (Bureau) approves the joint application of Neptune Communications, L. L. C. (“ Neptune Communications”), Alaska Fiber Star License Corporation, and Northstar License Corporation requesting permanent authority to transfer control over Alaska Fiber Star, L. L. C. (“ AFS”) and WCI Cable, Inc. (“ WCI Cable”) from AMP Life to Neptune Communications. AFS and WCI Cable are authorized to provide domestic interstate telecommunications services. 1 Although Chandalar Communications Corporation, a newly- formed Oregon corporation, filed comments notifying the Commission that Chandalar has submitted “a competing and higher bid” than Neptune for control of WCI Cable that may ultimately be accepted by the relevant bankruptcy court in lieu of Neptune’s bid, no comments or petitions to deny have been filed in opposition to the instant application. 2 The Bureau finds, upon consideration of the record, that the proposed transfer will serve the public interest, convenience and necessity, and therefore grants the requested authorization. Pursuant to section 1.103 of the Commission’s rules, 47 C. F. R. § 1.103, the consent granted herein is effective upon release of the Public Notice. Petitions for reconsideration under section 1.106 or applications for review under section 1.115 of the Commission’s rules, 47 C. F. R. §§ 1.106, 1.115, may be filed within 30 days of the date of this Public Notice.
