The Audio Division considers herein the Notice of Proposed Rule Making (“ Notice”) 1 , which includes the captioned proceeding. The Notice set forth two separate proposals to allot FM channels to two specific communities. 2 Charles Crawford (“ Crawford”), requests the allotment of Channel 289A to Oak Grove, Louisiana, as that community’s second local aural transmission service. Crawford filed comments reiterating an intention to apply for Channel 289A if it is allotted to Oak Grove, as requested. No counterproposals or additional comments were received in response to the above- listed docket. 2. In view of the interest expressed in providing an additional local aural transmission service to Oak Grove, Louisiana, we will allot Channel 289A to that community, as requested. As stated in the Notice, Channel 289A can be allotted to Oak Grove in compliance with the Commission’s minimum distance separation requirements with a site restriction 11. 3 kilometers (7 miles) east to avoid short- spacing to the license site of Station KVVP, Channel 289C3, Leesville, Louisiana. 3 3. Accordingly, pursuant to the authority found in Sections 4( i), 5( c)( 1), 303( g) and (r) and 307( b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204( b) and 0.283 of the Commission’s rules, IT IS ORDERED, That effective March 3, 2003, the FM Table of Allotments, Section 73.202( b) of the Commission’s Rules, IS AMENDED, with respect to the communities listed below, to read as follows: Community Channel No. Oak Grove, Louisiana 244C3, 289A 1 See Oak Grove and Opelousas, Louisiana, 17 FCC Rcd 20089 (MB 2002). 2 The proposals set forth in the multiple Notice were not mutually exclusive with each other. A separate Report and Order will be issued for the Opelousas, Louisiana proceeding (MB Docket No. 02- 322). 3 The reference coordinates for Channel 289A at Oak Grove are 29- 43- 41 NL and 93- 00- 05 WL. 1 Federal Communications Commission DA 03- 143 2 4. The window period for filing applications for Channel 289A at Oak Grove, Louisiana will not be opened at this time. Instead, the issue of opening this allotment for auction will be addressed by the Commission in a subsequent order. 5. IT IS FURTHER ORDERED, That the aforementioned proceedings ARE TERMINATED. 6.
