File No. 649 Comments Due: May 30, 2003 Section 214 Application Applicant: InterAccess Telecommunications Company d/ b/ a Hosting. com On May 2, 2003, InterAccess Telecommunications Company d/ b/ a Hosting. com (InterAccess or Applicant) located at 170 Tracer Lane, Suite 300, Waltham, Massachusetts 02451 filed an application with the Federal Communications Commission (FCC or Commission), requesting authority under section 214( a) of the Communications Act of 1934, as amended, 47 U. S. C. § 214( a), and section 63.71 of the Commission's rules, 47 C. F. R. § 63.71, to discontinue the provision of retail DSL service in Illinois. The application states that InterAccess is a wholly owned subsidiary of Allegiance Internet, Inc. and an indirect wholly- owned subsidiary of Allegiance Telecom, Inc. InterAccess states that it is certificated by the Illinois Commerce Commission to provide local exchange and intrastate toll services, and that it provides DSL service to business customers in the Chicago metropolitan area. The application indicates that InterAccess currently provides DSL service to approximately 1200 customers, all of which are located in the Chicago metropolitan area. InterAccess states that it plans to discontinue providing DSL service in Illinois on May 31, 2003, or as soon thereafter as all necessary governmental approvals can be obtained. InterAccess indicates that it notified all of its Illinois DSL customers that it planned to discontinue providing DSL service on May 31, 2003, by letters dated March 27 and March 28, 2003. In accordance with 47 C. F. R. § 63.71( c), the application will be deemed to be automatically granted on the thirty- first (31 st ) day after the release date of this notice, unless the Commission has notified the Applicant that the grant will not be automatically effective. Accordingly, pursuant to section 63.71( c), absent further Commission action, InterAccess may not terminate service to the customers affected by this application until June 16, 2003. This proceeding is considered a “permit but disclose” proceeding for purposes of the Commission's ex parte rules, 47 C. F. R. §§ 1.1200 - 1.1216. Comments objecting to this application must be filed with the Commission on or before May 30, 2003. Such comments should refer to Comp. Pol. File No. 649. Comments should include specific information about the impact of this proposed discontinuance on the commenter, including any inability to acquire reasonable substitute service.
