The Audio Division considers herein the Notice of Proposed Rule Making (“ Notice”) 1 , issued at the request of George S. Kalman (“ Petitioner”), proposing the allotment of Channel 291A to Okeechobee, Florida, as that community’s first local aural transmission service. Petitioner filed comments reiterating an intention to apply for Channel 291A if allotted to Okeechobee, as requested. 2 No counterproposals or additional comments were received in response to this proceeding. 2. In view of the interest expressed in providing a first local aural transmission service to Okeechobee, we will allot Channel 291A to that community, as requested. As stated in the Notice, Channel 291A can be allotted to Okeechobee, in compliance with the Commission’s minimum distance separation requirements, provided there is a site restriction of 13 kilometers (8. 1 miles) northwest of the community. 3 3. Accordingly, pursuant to the authority found in Sections 4( i), 5( c)( 1), 303( g) and (r) and 307( b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204( b) and 0.283 of the Commission’s rules, IT IS ORDERED, That effective August 18, 2003, the FM Table of Allotments, Section 73.202( b) of the Commission’s Rules, IS AMENDED, with respect to the community listed below, to read as follows: Community Channel No. Okeechobee, Florida 291A 1 See Okeechobee, Florida, 18 FCC Rcd 6202 (MB 2003). 2 In compliance with § 1.52 of the Commission Rules, Petitioner was requested to include with its comments verification that the statements contained in the petition are accurate to the best of its knowledge. The window period for filing applications for Channel 291A at Okeechobee will not be opened at this time. Instead, the issue of opening this allotment for auction will be addressed by the Commission in a subsequent order. 5. IT IS FURTHER ORDERED, That this proceeding IS TERMINATED. 6.
