On April 25, 2002, Westmarc Development Joint Venture d/ b/ a AT& T Broadband (“ AT& T”), filed with the Commission an appeal of a local rate order adopted by the City of Santa Rosa, California (“ City”) on March 26, 2002. 2. In a Joint Motion to Withdraw filed on October 18, 2002, AT& T states that it has now reached an acceptable resolution of this matter with the City. AT& T and the City together request that the appeal, as well as all subsequent filings related to this proceeding be withdrawn and dismissed with prejudice and without benefit of substantive Commission review. 3. Accordingly, IT IS ORDERED that the Joint Motion to Withdraw filed by Westmarc Development Joint Venture d/ b/ a AT& T Broadband and the City of Santa Rosa, California IS GRANTED and the appeal filed on April 25, 2002 IS DISMISSED. 4.
