Kimball@ fcc. gov DA 03- 2407 Released: July 23, 2003 CONSUMER & GOVERNMENTAL AFFAIRS BUREAU ANNOUNCES CORRECTED EFFECTIVE DATE OF RULES ADOPTED IN SLAMMING THIRD ORDER ON RECONSIDERATION Corrected Effective Date; Rules are Effective on July 21, 2003 CC Docket No. 94- 129 The Consumer & Governmental Affairs Bureau of the Federal Communications Commission announces that the requirements the Commission adopted in its Third Order on Reconsideration (Reconsideration Order) in the slamming proceeding, Implementation of the Subscriber Carrier Selection Changes Provisions of the Telecommunications Act of 1996, Policies and Rules Concerning Unauthorized Changes of Consumers Long Distance Carriers, CC Docket No. 94- 129, FCC 03- 42 (rel. March 17, 2003) and clarified in a subsequent Order, CC Docket No. 94- 129, FCC 03- 116 (rel. May 23, 2003), are effective on July 21, 2003. Due to an administrative error, two differing effective dates were published in the Federal Register. The correct effective date should be July 21, 2003. The Commission’s slamming rules are designed to improve the carrier change process for consumers and carriers while making it more difficult for unscrupulous carriers to perpetrate slams. The following modifications adopted in the Commission’s Reconsideration Order contained information collections: 47 CFR Sections 64.1120( c)( 3)( iii), 64.1130( j), 64.1150( b), 64.1160( g), 64.1170( g), 64.1180, requirements concerning local exchange carrier verification of in- bound carrier changes, and certifications to exempt carriers from the drop- off requirement. A summary of the Reconsideration Order was published at 68 FR 19152 (April 18, 2003) and was clarified at 68 FR 40184 (July 7, 2003). The information collections contained in the Reconsideration Order were approved by the Office of Management and Budget (OMB) on July 1, 2003. OMB Control Number 3060- 0787. Notice of the effective date was published in the Federal Register on July 21, 2003.
