On July 2, 1997, Heritage Cablevision, Inc. (“ Heritage”) filed with the Commission an appeal of a local rate order adopted by the City of Windsor Heights, Iowa (“ City”) on June 2, 1997. Heritage also filed a Request for Emergency Stay on July 17, 1997. 2. In a Motion to Withdraw Appeal of Local Rate Order filed on November 14, 2002, Heritage states that it has now reached an acceptable resolution of this matter with the City and the dispute is now moot. Heritage requests that the appeal, request for emergency stay, as well as all filings related to this proceeding be withdrawn and dismissed without benefit of substantive Commission review. 3. Accordingly, IT IS ORDERED that the Motion to Withdraw Appeal of Local Rate Order filed by Heritage Cablevision, Inc. IS GRANTED and the appeal filed on July 2, 1997 IS DISMISSED. 4.
