On June 26, 2003, Century- TCI California, L. P. d/ b/ a Adelphia Cable Communications (“ Adelphia”) filed with the Commission an Appeal of Local Rate Order adopted by the City of Los Angeles, California (“ City”) on May 30, 2003. Adelphia also filed a Request for Emergency Stay on June 9, 2003. The City opposed the stay request. The Media Bureau denied Adelphia’s stay request in Order, DA 03- 2554, released on July 29, 2003. 2. In a Motion to Withdraw Appeal of Local Rate Order filed on August 29, 2003, Adelphia states that it now intends to comply with the terms of the City’s rate order and that there is no longer a need for Commission review. Adelphia requests that this proceeding be dismissed. 3. Accordingly, IT IS ORDERED that the Motion to Withdraw Appeal of Local Rate Order filed by Century- TCI California, L. P. d/ b/ a Adelphia Cable Communications IS GRANTED and the Appeal filed on June 26, 2003 IS DISMSSED. 4.
