On November 8, 2002, Time Warner Cable (“ TWC”) filed with the Commission an appeal of a local rate order adopted by the Miami Valley Communications Council (“ MVCC”). The rate order established regulated rates for basic cable service and associated equipment and installation. 2. In a Motion to Withdraw Appeal of Local Rate Order filed on October 17, 2003, TWC requests that the appeal be withdrawn and dismissed. TWC indicates that Counsel for the MVCC concurs with this motion. 3. Accordingly, IT IS ORDERED that the Motion to Withdraw Appeal of Local Rate Order filed by Time Warner Cable IS GRANTED and the appeal filed on November 8, 2002 IS DISMISSED. 4.
