File No. 666 Comments Due: December 16, 2003 Section 214 Application Applicant: Broadwing Local Services Inc. On November 17, 2003, Broadwing Local Services Inc. (Broadwing or Applicant) located at 201 East Fourth Street, Cincinnati, Ohio 45201 filed an application with the Federal Communications Commission (FCC or Commission), requesting authority under section 214( a) of the Communications Act of 1934, as amended, 47 U. S. C. § 214( a), and section 63.71 of the Commission's rules, 47 C. F. R. § 63.71, to discontinue the provision of U. S. domestic local services to customers in certain geographic areas. The application states that the Broadwing seeks authority to discontinue the provision of U. S. domestic local services in the District of Columbia, Florida, Michigan, New York and Texas. The application indicates that Broadwing is non- dominant with respect to these services. Broadwing states that it has provided the notice required by the Commission’s rules to send a copy of the application to the Secretary of Defense, Attn. Special Assistant for Telecommunications, and the public utility commissions and governors, where applicable, of the District of Columbia, Florida, Michigan, New York and Texas. Broadwing further states that it has never provided services to customers in the affected locations, and consequently, that it does not have any customers to notify of the planned discontinuance. In accordance with 47 C. F. R. § 63.71( c), the application will be deemed to be automatically granted on the thirty- first (31 st ) day after the release date of this notice, unless the Commission has notified the Applicant that the grant will not be automatically effective. Accordingly, pursuant to section 63.71( c), absent further Commission action, Broadwing may not terminate service to the customers affected by this application until January 2, 2004. The Commission will normally authorize proposed discontinuances of service unless it is shown that customers or other end users would be unable to receive service or a reasonable substitute from another carrier, or that the public convenience and necessity would be otherwise adversely affected.
