The Audio Division considers herein the Notice of Proposed Rule Making (“ Notice”) 1 , issued at the request of Robert Fabian (“ Fabian”), proposing the allotment of Channel 224C2 to Buffalo, Oklahoma, as that community’s first local aural transmission service. 2 Fabian filed comments reiterating an intention to apply for Channel 224C2 if it is allotted to Buffalo, as requested. No counterproposals or additional comments were received in response to this proceeding. 2. In view of the interest expressed in providing a first local aural transmission service to Buffalo, Oklahoma, we will allot Channel 224C2 to that community, as requested. As stated in the Notice, Channel 224C2 can be allotted to Buffalo, in compliance with the Commission’s minimum distance separation requirements, provided there is a site restriction of 19.8 kilometers (12.3 miles) east of the community. 3 3. Accordingly, pursuant to the authority found in Sections 4( i), 5( c)( 1), 303( g) and (r) and 307( b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204( b) and 0.283 of the Commission’s rules, IT IS ORDERED, That effective May 5, 2003, the FM Table of Allotments, Section 73.202( b) of the Commission’s Rules, IS AMENDED, with respect to the community listed below, to read as follows: Community Channel No. Buffalo, Oklahoma 224C2 1 See Buffalo, Oklahoma, 17 FCC Rcd 25337 (MB 2002). 2 Buffalo is a community with a 2000 U. S. Census population of 1,200 persons. In support of the proposal, Petitioner indicates that Buffalo has its own local government, post office, city hall, fire department, schools, and numerous churches that serve the community. 3 The reference coordinates for Channel 224C2 at Buffalo are 36- 50- 36 NL and 99- 24- 30 WL. 1 Federal Communications Commission DA 03- 834 2 4. The window period for filing applications for Channel 224C2 at Buffalo, Oklahoma will not be opened at this time. Instead, the issue of opening this allotment for auction will be addressed by the Commission in a subsequent order. 5. IT IS FURTHER ORDERED, That this proceeding IS TERMINATED. 6.
