C. 20554 News Media Information 202 / 418- 0500 Fax- On- Demand 202 / 418- 2830 TTY 202 / 418- 2555 Internet: http:// www. fcc. gov ftp fcc gov DA 03- 850 March 25, 2003 MEDIA BUREAU ACTION Effective Date of SHVIA Network Non- Duplication, Syndicated Exclusivity, And Sports Blackout Rule Provisions Requiring OMB Approval CS Docket No. 00- 2 In response to the Commission’s Report and Order in CS Docket No. 00- 2, Implementation of the Satellite Home Viewer Improvement Act of 1999: Application of Network Non- duplication, Syndicated Exclusivity and Sports Blackout Rules to Satellite Retransmission of Broadcast Signals (FCC 00- 388, 15 FCC Rcd 21688 (2000)), parties filed petitions to reconsider certain aspects of the exclusivity rules adopted therein. In its Order on Reconsideration in the same docket (FCC 02- 287, 17 FCC Rcd 20693 (2002)), the Commission denied petitions to extend the phase- in period for implementation of the rules, and also maintained the application of the sports blackout rule to satellite carriage of network stations. The Commission made revisions to conform the satellite rules to the cable rules and amended a rule to permit sports rights holders with a discernable season to submit blackout notifications for an entire season, but also to establish a date certain by when those notifications must be received by satellite carriers. Sections 76.122( c)( 2) and 76. 127( c) of the rules adopted in the Order on Reconsideration, which was published in the Federal Register at 67 FR 68944 (November 14, 2002), contained new or modified information collection requirements that required approval from the Office of Management and Budget (OMB) before they could become effective. The information collection requirements were approved by the Office of Management and Budget on March 10, 2003 (OMB No. 3060- 0960). Accordingly, sections 76.122( c)( 2) and 76.127( c) of the Network Non- duplication Protection, Syndicated Exclusivity and Sports Blackout rules became effective upon publication of notice in the Federal Register on March 25, 2003. Also in the Federal Register of March 25, 2003, is a Correction of section 76.127( c), conforming the version published at 67 FR 68944, 68951 with the version as adopted in the Order on Reconsideration at 17 FCC Rcd 20693, 20712.
