 1.  At  the  request  of  River  City  Broadcasting  [formerly  Channel  42  of  Little  Rock,  Inc.]  (“  River  City"),  licensee  of  station  KWBF-  TV  [formerly  KYPX(  TV)],  NTSC  channel  42,  Little 
 Rock,  Arkansas,  the  Commission  has  before  it  the  Notice  of  Proposed  Rule  Making,  15  FCC  Rcd  14841  (2000),  proposing  the  substitution  of  DTV  channel  44  for  station  KWBF-  TV's  assigned  DTV 
 channel  43.  1  River  City  Broadcasting,  Inc.  ("  River  City")  and  KM  Television  of  El  Dorado,  LLC  ("  KM")  filed  comments.  2  River  City,  KM  and  Equity  Broadcasting  Corporation  ("  EBC")  filed  reply 
 comments. 
 2.  River  City  filed  comments  supporting  the  channel  substitution.  River  City  asserts  that  the  adoption  of  the  channel  substitution  at  Little  Rock  will  permit  the  collocation  of  KWBF’s  digital  and 
 analog  facilities.  River  City  also  states  that  it  continues  to  search  for  a  displacement  channel  for  KHTE-  LP. 


 3.  We  believe  the  public  interest  would  be  served  by  substituting  DTV  channel  44  for  DTV  channel  43  since  it  will  enable  KWBF-  DT  to  co-  locate  its  analog  and  digital  facilities.  In  addition, 
 we  find  that  this  channel  is  acceptable  under  the  2  percent  criterion  for  de  minimis  impact  that  is  applied  in  evaluating  requests  for  modification  of  initial  DTV  allotments  under  Section  73.623(  c)(  2) 
 for  Station  KWBF-  DT  with  the  following  specifications:

 1  River  City  is  now  the  licensee  of  station  of  KWBF-  TV  pursuant  to  the  Commission’s  grant  of  the  assignment  of 
 license  (File  No.  BALCT-  20000321ABI). 
 2  KM  filed  supporting  comments  indicating  that  the  grant  of  River  City’s  proposal  would  serve  the  public  interest 
 by  eliminating  the  potential  for  interference  to  channel  43  at  El  Dorado,  Arkansas.

 3.  Accordingly,  pursuant  to  the  authority  contained  in  Sections  4(  i),  5(  c)(  1),  303(  g)  and  (r)  and  307(  b)  of  the  Communications  Act  of  1934,  as  amended,  and  Sections  0.61,  0.204(  b)  and  0.283 
 of  the  Commission's  Rules,  IT  IS  ORDERED,  That  effective  March  3,  2003,  the  DTV  Table  of  Allotments,  Section  73.622(  b)  of  the  Commission's  Rules,  IS  AMENDED,  with  respect  to  the 
 community  listed  below,  to  read  as  follows:

 4.  IT  IS  FURTHER  ORDERED,  That  within  45  days  of  the  effective  date  of  this  Order,  River  City  Broadcasting,  Inc.  shall  submit  to  the  Commission  a  minor  change  application  for  a 
 construction  permit  (FCC  Form  301)  specifying  DTV  Channel  44  in  lieu  of  DTV  Channel  43c  for  station  KWBF-  DT. 


 5.  IT  IS  FURTHER  ORDERED,  That  this  proceeding  IS  TERMINATED.
