On September 23, 2003, the Enforcement Bureau issued a Public Notice stating that the Office of Engineering and Technology had determined that certain vehicle battery chargers manufactured and distributed in the United States by Vector Products, Inc. d/ b/ a Vector Manufacturing, Ltd. (“ Vector”) were not in compliance with the technical standards of Part 15 of the Commission’s Rules. 1 The Public Notice advised retailers that continued marketing of the battery chargers would constitute a violation of Section 302( b) of the Communications Act of 1934, as amended, (“ Act”) 2 and Section 2.803( a) of the Commission’s Rules (“ Rules”). 3 On October 23, 2003, Vector filed a petition for reconsideration of that Public Notice. 4 2. On April 2, 2004, Vector filed a motion to withdraw the petition for reconsideration. 5 Vector notes that it has entered into a Consent Decree with the Enforcement Bureau and the Office of Engineering and Technology which terminates the Enforcement Bureau’s investigation into the Vector battery chargers and resolves all matters related to Vector’s petition for reconsideration. 6 In this Order, we grant Vector’s motion and dismiss its petition for reconsideration. 1 Public Notice, Notice Regarding Non- Compliant Battery Chargers, DA 03- 2923 (September 23, 2003). 2 47 U.
