On May 6, 2004, Adelphia Cable Communications (“ Adelphia”) filed with the Commission an appeal of a local rate order adopted by the Town of Hilton Head Island, SC (“ Town”) on April 6, 2004. Adelphia also requested an emergency stay of the rate order. The rate order established regulated rates for basic cable service and associated equipment and installation. 2. In a Motion to Withdraw Appeal and Stay Request Regarding Local Rate Order filed on May 14, 2004, Adelphia states it has reached an acceptable resolution with the Town regarding this matter and the dispute is now moot. Adelphia requests that the appeal and stay request be dismissed without benefit of substantive Commission review. 3. Accordingly, IT IS ORDERED that the Joint Motion to Withdraw Appeal and Stay Request Regarding Local Rate Order filed by Adelphia Cable Communications IS GRANTED and the request for emergency stay and appeal ARE DISMISSED. 4.
