C. 20554 News Media Information 202 / 418- 0500 Internet: http:// www. fcc. gov TTY: 1- 888- 835- 5322 DA 04- 1685 June 9, 2004 WIRELINE COMPETITION BUREAU EXTENDS REPLY COMMENT DEADLINES FOR IP- ENABLED SERVICES RULEMAKING AND SBC’S “IP PLATFORM SERVICES” FORBEARANCE PETITION WC DOCKET NOS. 04- 29, 04- 36 Revised Reply Comment Deadline: July 14, 2004 On March 29, 2004, the Wireline Competition Bureau issued a public notice indicating that initial comments in the Commission’s IP- Enabled Services rulemaking proceeding (WC Docket No. 04- 36) would be due on or before May 28, 2004, and that reply comments would be due on or before June 28, 2004. 1 On March 30, 2004, citing similarities in the issues raised by the two proceedings, the Wireline Competition Bureau extended the previously established deadlines for comments and reply comments relating to SBC Communications Inc. ’s petition for forbearance from application of Title II common carrier regulation to “IP Platform Services” 2 (WC Docket No. 04- 29) to match the deadlines established in the IP- Enabled Services docket. 3 On June 8, 2004, CompTel/ ASCENT (“ CompTel”) filed a motion to extend the deadlines for filing reply comments in these two dockets to July 14, 2004. 4 CompTel states that “in light of the volume of comments that these matters have generated, the time period between May 28 and June 28 is inadequate to permit CompTel and others to provide the Commission with a full, informed reply” to the initial comments. 5 CompTel further argues that the brief extension 1 See Public Notice, “Pleading Cycle Established for Comments in IP- Enabled Services Rulemaking Proceeding,” DA 04- 888 (rel. Mar. 29, 2004). 2 SBC defined “IP Platform Services” to include networks relying on IP, the capabilities and functionalities of those networks, and services and applications utilizing those networks to facilitate communications. 3 See Public Notice, “Wireline Competition Bureau Extends Comment Deadlines for SBC’s ‘IP- Platform Services’ Forbearance Petition,” DA 04- 899 (rel. Mar. 30, 2004). 4 See CompTel/ ASCENT’s Motion for Extension of Time, WC Docket Nos. 04- 29, 04- 36 (filed June 8, 2004). 5 See id. at 2. Parties have submitted over 150 initial comments in these two proceedings. 1 requested would not prejudice any party to the proceeding. 6 It is the policy of the Commission that extensions of time are not routinely granted. 7 In this case, however, the Bureau finds that CompTel has shown good cause for an extension of the deadline for filing reply comments in these proceedings. In light of the complexity of the issues involved and the unusually high number of initial comments received, we grant a limited extension so that parties may file reply comments in these two dockets on or before July 14, 2004.
