At the request of Eastern New Mexico University (“ ENMU”), the Commission has before it the Notice of Proposed Rule Making, 18 FCC Rcd 18116 (2003), proposing the allotment of DTV channel *47 to Hobbs, New Mexico, as the community’s second local DTV service. 1 ENMU filed comments restating its intention to apply for the new noncommercial allotment at Hobbs, New Mexico. No other comments were received. 2. We believe the public interest would be served by allotting DTV channel *47 to Hobbs, New Mexico, since this action will provide the community with its first noncommercial DTV channel and a second local DTV service. DTV channel *47 can be allotted to Hobbs, New Mexico, as proposed, in compliance with Sections 73.623( d) and 73.625( a) at coordinates 32- 45- 20 N. and 103- 11- 09 W. 3. Accordingly, pursuant to the authority contained in Sections 4( i), 5( c)( 1), 303( g) and (r) and 307( b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204( b) and 0.283 of the Commission's Rules, IT IS ORDERED, That effective March 22, 2004, the DTV Table of Allotments, Section 73.622( b) of the Commission's Rules, IS AMENDED, with respect to the community listed below, to read as follows: City Channel No. Hobbs, New Mexico 16, *47 4. A separate Order will be issued announcing the window period for filing applications for DTV channel *47 at Hobbs, New Mexico. 1 In its petition for rule making, ENMU stated that the adoption of its proposal would constitute Hobb's first noncommercial DTV allotment. ENMU also claimed that the allotment of DTV channel *47 would reduce the white and gray areas in portions of New Mexico not served by a noncommercial educational DTV station. 1 Federal Communications Commission DA 04- 264 2 5.
