In response to a Petition for Rule Making filed by Broadcast Equities Corp. (“ Petitioner”), the Audio Division considers herein a Notice of Proposed Rule Making (“ Notice”) 1 proposing the allotment of Channel 276A to Dexter, Georgia, as that community’s first local aural transmission service. Petitioner did not file comments. Great Southern Radiocasting filed comments supporting the grant of the proposal set forth in the Notice and stating that if the rulemaking proposal is approved, it would file an application for authority to construct and operate an FM station in Dexter, utilizing Channel 276A. Dowdy Partners, licensee of Station WDBN( FM), Wrightsville, Georgia, submitted comments stating that adoption of the Notice’s proposal would serve the public interest. No counterproposals or other comments have been filed. As explained below, we allot Channel 276A to Dexter, Georgia. 2. We believe that the public interest would be served by the allotment of Channel 276A at Dexter, Georgia, since it will provide a first local aural transmission service to that community. 2 Channel 276A can be allotted to Dexter, Georgia, consistent with the technical requirements of the Commission’s rules, at coordinates 32- 25- 59 NL and 83- 01- 33 WL, with a site restriction of 3.3 kilometers (2.1 miles) east of Dexter. 3. The Commission will send a copy of this Report and Order in a report to be sent to Congress and the General Accounting Office pursuant tot he Congressional Review Act, see 5 U. S. C. Section 801( a)( 1)( A). 4. Accordingly, pursuant to the authority contained in 47 U. S. C. Sections 4( i), 5( c)( 1), 303( g) and (r) and 307( b) and 47 C. F. R. Sections 0.6l, 0.204( b) and 0.283, IT IS ORDERED, That effective December 13, 2004, the FM Table of Allotments, Section 73.202( b) of the Commission’s Rules IS AMENDED for the community listed listed below, as follows: 1 19 FCC Rcd 4614 (MB 2004). 2 Dexter is an incorporated community with a 2000 U. A filing window for Channel 276A, Dexter, Georgia, will not be opened at this time. Instead, the issue of opening this allotment for auction will be addressed by the Commission in a subsequent order. 6. IT IS FURTHER ORDERED, That this proceeding IS TERMINATED. 7.
