At the request of Global Education Development, Inc., Broadcasting for the Challenged, Inc., Faith That Pleases God Church, Family Educational Broadcasting, Inc., Creative Educational Media Corporation, Oral Roberts University, and Community Television Educators, Inc., jointly referred to as the “Applicants”, the Commission has before it the Notice of Proposed Rule Making, 19 FCC Rcd 13160 (2004), proposing the substitution of DTV channel *26 for channel *63 at Tulsa. The Applicants and Motorola, Inc. filed supporting comments. 1 2. As stated in the Notice, the Applicants filed their petition for rule making pursuant to the provisions outlined in the Commission’s Public Notice (“ Public Notice”) released on November 22, 1999, DA 99- 2605. In that Public Notice, the Commission announced a window filing opportunity to allow persons with certain pending requests for new analog television stations to modify their requests to eliminate technical conflicts with digital television stations and to move from channels 60 through 69. The Applicants requested a DTV channel as the replacement for channel *63 at Tulsa. 3. We believe the public interest would be served by allotting DTV channel *26 since it will permit the Applicants to move from TV channels 60 through 69. DTV channel *26 can be allotted to Tulsa, Oklahoma, consistent with the criteria set forth in the Commission’s Public Notice regarding the allotment of a DTV channel in lieu of a NTSC channel allotment. The coordinates for DTV channel *26 at Tulsa are 36- 04- 56 N. and 95- 45- 27 W. DTV channel *26 can be allotted to Tulsa with the following specifications: 1 Motorola, Inc. supports the Applicants proposal stating that the presence of channel *63 precludes the public safety community from operating on channels 63 and 64 due to co- channel and adjacent channel interference. Accordingly, pursuant to the authority contained in Sections 4( i), 5( c)( 1), 303( g) and (r) and 307( b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204( b) and 0.283 of the Commission's Rules, IT IS ORDERED, That effective January 14, 2005, the TV Table of Allotments, Section 73.606( b) of the Commission's Rules, IS AMENDED, with respect to the community listed below, to read as follows: City Channel No. Tulsa, Oklahoma 2+, 6+, 8-, *11-, 23, 41+, 47, and 53 5. IT IS FURTHERED ORDERED, That effective January 14, 2005, the DTV Table of Allotments, Section 73.622( b) of the Commission's Rules, IS AMENDED, with respect to the community listed below, to read as follows: City Channel No. Tulsa, Oklahoma 10, 22, *26, *38, 42c, 48c, 49, 55, and 56 6. IT IS FURTHER ORDERED, That within 45 days of the effective date of this Order, the Applicants shall submit to the Commission minor change applications for a construction permit (FCC Form 340) specifying DTV Channel *26 in lieu of TV Channel *63 at Tulsa. 7.
