At the request of Montana State University (“ MSU”), the Commission has before it the Notice of Proposed Rule Making, 19 FCC Rcd 14440 (2004), proposing the allotment and reservation of DTV channel 46 for noncommercial use at Kalispell, Montana. MSU filed comments reaffirming its interest in applying for a new noncommercial station at Kalispell, if allotted. No other comments were received. 2. We believe the public interest would be served by allotting DTV channel *46 to Kalispell since it would provide the community with its first local noncommercial educational television service. DTV channel *46 can be allotted to Kalispell, Montana, as proposed, in compliance with Sections 73.623 (d) and 73.625( a) of the Commission’s rules at coordinates 48- 00- 48 N. and 114- 21- 55 W. Since the community of Kalispell is located within 400 kilometers of the U. S.- Canadian border, concurrence from the Canadian was obtained for this allotment. 3. Accordingly, pursuant to the authority contained in Sections 4( i), 5( c)( 1), 303( g) and (r) and 307( b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204( b) and 0.283 of the Commission's Rules, IT IS ORDERED, That effective January 14, 2005, the DTV Table of Allotments, Section 73.622( b) of the Commission's Rules, IS AMENDED, with respect to the community listed below, to read as follows: City Channel No. Kalispell, Montana 38, *46 4. A separate Order will be issued announcing the window period for filing applications for DTV channel *46 at Kalispell, Montana. 5.
