At the request of Thomas Desmond (“ petitioner”), the Commission has before it the Notice of Proposed Rule Making, 19 FCC Rcd 12816 (2004), proposing the allotment of DTV channel 51 to Medical Lake, Washington. Petitioner filed comments indicating his continuing interest in applying for DTV channel 51, if allotted. No other comments were received. 2. We believe the public interest would be served by allotting DTV channel 51 since it could provide the community of Medical Lake 1 with its first local television service. DTV channel 51 can be allotted to Medical Lake, Washington, as proposed, in compliance with Sections 73.623( d) and 73.625( a) at coordinates 47- 34- 12 N. and 117- 41- 32 W. Since the community of Medical Lake is located within 400 kilometers of the U. S.- Canadian border, concurrence from the Canadian government was obtained for this allotment. 3. Accordingly, pursuant to the authority contained in Sections 4( i), 5( c)( 1), 303( g) and (r) and 307( b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204( b) and 0.283 of the Commission's Rules, IT IS ORDERED, That effective February 18, 2005, the DTV Table of Allotments, Section 73.622( b) of the Commission's Rules, IS AMENDED, with respect to the community listed below, to read as follows: City Channel No. Medical Lake, Washington 51 4. A separate Order will be issued announcing the window period for filing applications for DTV channel 51 at Medical Lake, Washington. 5.
