At the request of Timothy D. Lischwe (“ Lischwe”), the Commission has before it the Notice of Proposed Rule Making, 18 FCC Rcd 19208 (2003), proposing the allotment of channel 49 to Osage Beach, Missouri. 1 Lischwe filed comments stating his continuing interest in applying for channel 49, if allotted. No other comments were received. 2. We believe the public interest would be served by allotting channel 49 to Osage Beach, Missouri, since it will provide the community with its first local television service. A staff engineering analysis indicates that channel 49 can be allotted to Osage Beach with a plus offset consistent with the minimum distance separation requirements of Sections 73.610 and 73.698 of the Commission Rules. The coordinates for channel 49+ at Osage Beach are 38- 17- 33 North Latitude and 92- 34- 24 West Longitude. 3. Accordingly, pursuant to the authority contained in Sections 4( i), 5( c)( 1), 303( g) and (r) and 307( b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204( b) and 0.283 of the Commission's Rules, IT IS ORDERED, That effective April 19, 2004, the TV Table of Allotments, Section 73.606( b) of the Commission's Rules, IS AMENDED, with respect to the community listed below, to read as follows: City Channel No. Osage Beach, Missouri 49+ 4. A window for filing applications for channel 49+ will be addressed by the Commission in 1 Lischwe filed his amended petition for rule making pursuant to the provisions outlined in the Commission’s Public Notice (“ Public Notice”) released on November 22, 1999.
