(BellSouth) filed a petition pursuant to section 10 of the Communications Act of 1934, as amended, 1 requesting that, to the extent the Commission determines section 271( c)( 2)( B) imposes the same unbundling obligations on Bell Operating Companies (BOCs) as established by section 251( c), the Commission should forbear from applying such unbundling obligations to broadband elements. 2 BellSouth argues that incumbent LECs should have no stand- alone unbundling obligations for broadband network elements that no longer meet the section 251( d)( 2) impair standard. 3 We note that BellSouth’s request is virtually identical to the request Verizon filed on October 24, 2003, which the Commission placed on Public Notice on October 27, 2003. 4 This Public Notice establishes certain procedural requirements relating to consideration of BellSouth’s Petition. This matter shall be treated as a “permit- but- disclose” proceeding in accordance with the Commission's ex parte rules. See 47 C. F. R. §§ 1.1200, 1.1206.
