File No. 679 Comments Due: April 6, 2004 Section 214 Application Applicant: PCI Communications, Inc. On March 4, 2004, PCI Communications, Inc. (PCI or Applicant), located at 135 Chalan Santo Papa, Hagatna, Guam 96910, filed an application with the Federal Communications Commission (FCC or Commission) requesting authority, under section 214( a) of the Communications Act of 1934, as amended, 47 U. S. C. § 214( a), and section 63.71 of the Commission’s rules, 47 C. F. R. § 63.71, to discontinue the provision of certain U. S. domestic telecommunications services in certain geographic areas. PCI states that it is a wholly owned subsidiary of Startec Global Communications Corporation (Startec). According to PCI, Startec negotiated a joint venture with EC Communications, LLC in 2003, involving the sale of PCI’s assets, including its entire customer base and its international section 214 authorizations. PCI states that its customers were notified of the impending sale and transfer of assets consistent with the Commission’s rules. PCI further states that applications filed for authority to transfer PCI’s international section 214 authorizations, and its minority interests in cable landing licenses were granted by the Commission in August of 2003. PCI indicates that these transactions did not, however, involve the assignment of PCI’s domestic section 214 authorization because PCI anticipated the redevelopment of its domestic telecommunications business. PCI states that this redevelopment has failed to occur, and that it currently does not have any customers. Consequently, in the current application, PCI seeks authority to discontinue its provision of domestic interexchange service in Guam and the Northern Marianas Islands. PCI states that it is non- dominant with respect to the domestic interexchange services it offers. The application indicates that PCI plans to discontinue service immediately upon receipt of authorization from the Commission. Accordingly, pursuant to section 63.71( c), absent further Commission action, PCI may not terminate service to the customers affected by this application until April 23, 2004. The Commission will normally authorize proposed discontinuances of service unless it is shown that customers or other end users would be unable to receive service or a reasonable substitute from another carrier, or that the public convenience and necessity would be otherwise adversely affected. This proceeding is considered a “permit but disclose” proceeding for purposes of the Commission’s ex parte rules, 47 C. F. R. §§ 1.1200- 1.1216. Comments objecting to this application must be filed with the Commission on or before April 6, 2004. Such comments should refer to WC Docket No. 04- 74 and Comp. Pol. File No. 679. Comments should include specific information about the impact of this proposed discontinuance on the commenter, including any inability to acquire reasonable substitute service.
