S. C. § 553( b)( 3)( A), the International Bureau (Bureau) provides the following information as guidance in connection with the Commission’s Critical Design Review (CDR) milestone for satellite authorizations. As part of the Bureau’s CDR milestone review, authorized entities should be prepared, upon request, to submit any or all of the following information: 1. The documentation package prepared for payload subsystem CDR and the resulting CDR Report and Actions Items list (preferably on CD- ROM, but paper is acceptable); 2. Evidence of payment up through the date of CDR, either through copies of cancelled checks or a letter signed by the authorized entity certifying payment and the amount and dates of those payments; and 3. Any revisions to the satellite manufacturing contract, whether modified, amended, or rescinded and replaced, or that reflect contractual arrangements in any way different from the contract previously submitted to the Commission to show compliance with the milestone for entering into a satellite manufacturing agreement. Authorized entities that are constructing their own satellite may be asked to provide the following additional information: 1. Evidence that the licensee either continues to own, or continues to have a right to use, manufacturing facilities required for final assembly of the spacecraft; 2. Evidence that the licensee continues to secure the services of a staff with relevant design and manufacturing expertise; 3. An attested copy of a document signed by a person or persons with appropriate responsibility authorizing use of the licensee’s resources to construct the satellite( s); 4. A copy of an appropriately authorized work schedule indicating that the satellites will be built within a time period consistent with the milestone schedule prescribed in the license; and 5. Evidence that the licensee continues to have adequate funds for near- term expenses. This guidance is based on existing Commission policy and precedent and is intended to identify information that the Commission may seek as it assesses compliance with the CDR milestone. This 1 2 guidance should provide authorized holders of spectrum with a greater understanding of the information that they may need to submit to the Commission in connection with the CDR milestone review. The Bureau notes, however, that the information used to determine if authorized entities have satisfied the CDR milestone may vary from case to case depending on the facts presented to the Bureau. Accordingly, other information may be used in addition to or instead of the information listed in this Public Notice. 2
