(SBC) filed a petition for forbearance from application of Title II common carrier regulation to “IP Platform Services” 1 (SBC Forbearance Petition). 2 On February 12, 2004, the Wireline Competition Bureau issued a Public Notice establishing a comment cycle for this proceeding. On March 10, 2004, the Commission released a separate Notice of Proposed Rulemaking (IP- Enabled Services NPRM) seeking comment on issues relating to services and applications making use of the Internet Protocol (IP). 3 A summary of that NPRM was published in the Federal Register on March 29, 2004, triggering the cycle for comments and reply comments (69 FR 16193, March 29, 2004). In light of the substantial overlap between the issues presented in the SBC Forbearance Petition and the IP- Enabled Services NPRM, and the likelihood that parties will raise similar or identical arguments in the two proceedings, we hereby amend the previously established comment cycle in this docket to match the cycle established for the IP- Enabled Services proceeding. Thus, comments relating to the SBC Forbearance Petition must be submitted on or before May 28, 2004, and reply comments on or before June 28, 2004. For further information regarding this proceeding contact Russell Hanser, 1 SBC defined “IP Platform Services” to include networks relying on IP, the capabilities and functionalities of those networks, and services and applications utilizing those networks to facilitate communications. 2 We note that SBC raised similar issues in a petition for declaratory ruling that was filed on the same day. See Petition of SBC Communications Inc. for a Declaratory Ruling (filed Feb. 5, 2004). We referenced this petition in the IP- Enabled Services NPRM and expect to resolve it in that proceeding. Thus, we encourage interested parties to file any comments relating to the declaratory ruling petition in that docket (WC Docket No. 04- 36).
