The Telecommunications Access Policy Division has under consideration Request for Review filed by the Battenkill Valley Supervisory Union, on behalf of Arlington School District, Arlington, Vermont. The Request for Review seeks review of a decision by the Schools and Libraries Division (SLD) of the Universal Service Administrative Company (Administrator). 1 For review of decisions by SLD, requests to the Commission must be filed within 60 days of the issuance of the SLD decision date. 2 Here, Arlington School District filed its request after the 60- day period, in contravention of our rules. 3 We therefore dismiss the Request for Review. 2. ACCORDINGLY, IT IS ORDERED, pursuant to authority delegated under sections 0.91, 0.291 and 54. 722( a) of the Commission's rules, 47 C. F. R. §§ 0. 91, 0.291 and 54. 722( a), that the Request for Review by Battenkill Valley Supervisory Union, on behalf of Arlington School District, Arlington, Vermont, dated February 03, 2005, IS DISMISSED. FEDERAL COMMUNICATIONS COMMISSION Vickie S. Robinson Deputy Chief Telecommunications Access Policy Division Wireline Competition Bureau 1 Letter from Michael Finch, Battenkill Valley Supervisory Union, to Federal Communications Commission, dated February 3, 2005 (Request for Review). Any person aggrieved by an action taken by a division of the Administrator may seek review from the Commission. 47 C. F. R. § 54. 719( c). 2 47 C. F. R. § 54. 720( b). The Request for Review was dated 169 days after the decision it appeals. 3 In the Request for Review, Arlington School District states that a January 2005 e- mail from SLD gave it the option of filing an appeal with SLD or the FCC. See Request for Review at 1. We conclude, however, that the e- mail was merely responding to an inquiry from the Arlington School District regarding the appeals process and did not affect the time allowed under the rules for filing an appeal. 1
