Browne & Associates 38710 Woodward Blvd Bloomfield, MI 48304 Re: Call Sign: E950022 SES- LIC- 20050228- 00243 Dear Mr. Browne: On February 28, 2005, you filed the above- captioned application on behalf of Scripps Howard Broadcasting Company for a conventional Ku- Band 1 Earth Station. We note that item E49 (Maximum EIRP Density per Carrier in dBW/ 4kHz) was specified as 0.0 for the 45M0G7W emission. We also note that the average EIRP Density per Carrier is computed to be 31.49 dBW/ 4 kHz by considering the 72.0 dBW EIRP per carrier specified in item E48, resulting in an internal inconsistency in the application. Given this inconsistency, we cannot determine the actual emission power in use. Accordingly, pursuant to Section 25.112( a)( 1) 2 of the Commission's rules, 47 C. F. R. § 25.112( a)( 1), and Section 0. 261 of the Commission’s rules on delegations of authority, 47 C. F. R. § 0.261, we dismiss your application as defective without prejudice to refiling. 3 Sincerely, Scott A. Kotler Chief, Systems Analysis Branch Satellite Division International Bureau 1 14. 0- 14.5 GHz band. 2 47 C. F. R. Section 25.112( a)( 1).
