On June 3, 2005, the International Bureau denied IBFS File No. SAT- STA- 20050321- 00068 and dismissed IBFS File Nos. SAT- MOD- 20050513- 00103 and SES- MFS- 20050527- 00662. See Echostar Satellite, LLC, Memorandum Opinion and Order, DA 05- 1581 (rel. June 3, 2005) (" EchoStar 4 Order"). On June 8, 2005, EchoStar Satellite L. L. C., filed a Petition for Reconsideration challenging the EchoStar 4 Order. On our own motion, we designate this proceeding as "permit- but- disclose" for purposes of the Commission's rules governing ex parte communications. We find that designating the proceeding as "permit- but- disclose" will facilitate resolution of the issues implicated by the underlying applications and the Petition for Reconsideration.
