C. 20554 News Media Information 202 / 418- 0500 Internet: http:// www. fcc. gov TTY: 1- 888- 835- 5322 DA 05- 1682 Released: June 16, 2005 MEDIA BUREAU ACTION CORRECTION TO PUBLIC NOTICE, DA 05- 1591, RELEASED ON JUNE 2, 2005: IN THE MATTER OF ADELPHIA COMMUNICATIONS CORPORATION, DEBTOR- IN-POSSESSION, TIME WARNER INC. AND COMCAST CORPORATION SEEK APPROVAL TO TRANSFER CONTROL AND/ OR ASSIGN FCC AUTHORIZATIONS AND LICENSES MB Docket No. 05- 192 On June 2, 2005, the Media Bureau released a Public Notice, DA 05- 1591, establishing a pleading cycle in the above- captioned matter in which Adelphia Communications Corporation, debtor- in-possession, Time Warner Inc. and Comcast Corporation (the “Applicants”) seek approval to transfer control and/ or assign FCC authorizations and licenses. On June 6, 2005, the Applicants submitted a letter containing a corrected list of television receive- only (“ TVRO”) earth stations to replace the list forwarded to the Commission with the Application and subsequently listed in the Attachment to the June 2, 2005 Public Notice. 1 An Erratum is being released today to correct the stations listed under “Part 25 – Satellite Communications Receive- Only Satellite Earth Stations (TVRO).” Other than the list of Part 25 TVRO earth stations, there are no other changes to the June 2, 2005 Public Notice. Because prior public notice and the establishment of a pleading cycle are not required for the transfer or assignment of receive- only earth stations, the issuance of this Erratum does not create a need to establish a new pleading cycle for this proceeding. 2 The pleading cycle established in the June 2, 2005, Public Notice, DA 05- 1591, will remain in place. 3 1 See letter from Steven J. Horvitz, of Cole, Raywid & Braverman, L. L. P., to JoAnn Lucanik, Federal Communications Commission, MB Docket No. 05- 192, dated June 6, 2005. 2 In the case of receive- only earth stations, our procedures do not require the filing of transfer or assignment applications, but instead require that the Applicants report the changes in station operator on FCC Form 312 and Schedule A. These changes are then published in the International Bureau’s routine Actions Taken public notices and recorded in the Bureau’s appropriate database. 3 Comments/ Petitions are due on July 5, 2005; Responses/ Oppositions to Petitions are due on July 20, 2005. 1
