A summary of the NPRM was published in the Federal Register on June 29, 2005, triggering the cycle for comments and reply comments. 2 This matter shall be treated as a “permit- but- disclose” proceeding in accordance with the Commission’s ex parte rules. Persons making oral ex parte presentations are reminded that memoranda summarizing the presentations must contain summaries of the substance of the presentations and not merely a listing of the subjects discussed. More than a one or two sentence description of the views and arguments presented is generally required. Other requirements pertaining to oral and written presentations are set forth in section 1.1206( b) of the Commission’s rules. 3 Pursuant to sections 1.415 and 1.419 of the Commission’s rules, 47 C. F. R §§ 1. 415, 1. 419, interested parties may file comments on or before August 15, 2005 and reply comments on or before 1 IP- Enabled Services, WC Docket No. 04- 36, E911 Requirements for IP- Enabled Service Providers, WC Docket No. 05- 196, First Report and Order and Notice of Proposed Rulemaking, FCC 05- 116 (rel. June 3, 2005). Together with the NPRM, the Commission adopted the First Report and Order in WC Docket No. 04- 36 (Order). In the Order, the Commission established rules requiring providers of interconnected voice over Internet Protocol (VoIP) – meaning VoIP service that allows a user generally to receive calls originating from and to terminate calls to the public switched telephone network (PSTN) – to provide enhanced 911 (E911) capabilities to their customers as a standard feature of the service, rather than as an optional enhancement. See id. As discussed in the Order, the effective date for the new information collection requirements set forth in the Order is subject to Office of Management and Budget (OMB) approval. See id. at para. 73. The Commission has requested OMB approval on an expedited basis pursuant to emergency request. See 70 Fed. Reg. 37, 403 (June 29, 2005).
