On September 9, 2005, the above- referenced multi- channel video program distributor (MVPD) Cox Communications (Cox) requested a six- month extension of the September 30 filing deadline for its MVPD EEO Program Annual Report (FCC Form 396- C) and EEO public file report, and a waiver of the Supplemental Investigation Sheet (SIS) filing requirement. 1 2. Cox reports that it is the primary cable operator serving New Orleans, Louisiana. It requests the extension and waiver in order to allow its Human Resources Department to spend its efforts on urgent matters relating to the safety and well- being of employees and their families in the aftermath of Hurricane Katrina. 3. Considering the totality of the circumstances in this case, we will grant an extension of the filing deadline for Cox’s MVPD EEO Program Annual Report and EEO public file report until March 30, 2006. We will not, however, waive the SIS filing requirement. Given the six month extension, we do not believe the requirement to answer the four questions on the SIS will be unduly burdensome. If this proves to be otherwise, Cox may raise the matter again prior to the due date. 4. Accordingly, IT IS ORDERED that the request by Cox Communications for an extension of time to file its EEO Program Annual Report and EEO public file report IS GRANTED until March 30, 2006. 5. Finally, IT IS ORDERED that a copy of this Order shall be sent by First Class and Certified Mail, Return Receipt Requested, to the unit’s attorney of record.
