Applicants assert that this transaction is entitled to presumptive streamlined treatment under section 63.03( b)( 2)( i) of the Commission’s rules because immediately following the proposed transaction: (1) Toepfer will have a market share in the interstate, interexchange market of less than ten percent (10%); (2) Toepfer will provide competitive telephone exchange services or exchange access services in geographic areas served by a dominant local exchange carrier that is not a party to the transaction; and (3) neither of the Joint Applicants is dominant with respect to any service. 2 TCI, a California corporation, is a non- dominant interexchange and competitive local exchange carrier operating in California, providing service to small and medium size business customers. The following individuals, both U. S. citizens, hold a ten percent (10%) or great interest in TCI: John Toepfer (20%); and Alice J. Burk (80%). Toepfer is an individual and a citizen of the United States. Pursuant to an agreement between the existing majority shareholder of TCI and Toepfer, Toepfer, who is the chief executive officer of TCI, will acquire additional shares in TCI, 1 47 C. F.
