C. 20554 News Media Information 202 / 418- 0500 Fax- On- Demand 202 / 418- 2830 TTY 202 / 418- 2555 Internet: http:// www. fcc. gov ftp. fcc. gov DA 05- 2759 Released: October 21, 2005 NOTICE OF STREAMLINED DOMESTIC 214 APPLICATION GRANTED WC Docket No. 05- 264 On September 20, 2005, the Wireline Competition Bureau issued a public notice seeking comment on the transfer of control of Red River Networks, LLC’s (“ RRN”) assets to NOSVA Limited Partnership (“ NOSVA”) (collectively, “Applicants”). 1 This application has been granted pursuant to the Commission’s streamlined procedures for domestic section 214 transfer of control applications. 2 The Wireline Competition Bureau has determined that grant of this application serves the public interest. 3 The Commission received one comment in opposition to the proposed transfer of control from Trans National Communications International, Inc. (“ TNCI”), requesting that the Commission deny the Applicants’ application. 4 TNCI asserts that RRN violated a court approved settlement agreement, arising out of a lawsuit that is unrelated to the instant transfer of control application, by failing to make a timely settlement payment to TNCI. 5 RRN filed reply comments in response to TNCI’s comments, which state that RRN promptly cured the breach by wiring funds to satisfy the past- due payment to TNCI, as was permitted pursuant to the settlement agreement. 6 RRN provided a copy of the wire transfer, as an attachment to its reply comments, as evidence of RRN’s payment. 7 1 Domestic Section 214 Application Filed For Transfer of Control of Red River Networks, LLC to NOSVA Limited Partnership, WC Docket No. 05- 264, DA 05- 2474 (rel.
