W., Suite 600 Washington, DC 20006 Dear Mr. Rodriguez: On September 4, 2005, Maritime Telecommunications Network, Inc. (MTN) requested special temporary authorization for three 2.4 meter C- Band earth stations to be operated on Carnival Cruise line ships in the Gulf Coast region affected by Hurricane Katrina. 1 Those ships are being used in connection with relief efforts in that region. The request was granted, conditioned upon completion of coordination. Upon further review, and given that the ships are not U. S. registered, we are treating this request as one for a waiver of Section 25. 221 of the Commission’s rules, and in particular of Section 25.221( e) concerning completion of coordination prior to commencement of operations. We conclude that grant of a waiver would serve the public interest under the circumstances. This waiver will expire on April 1, 2006, and is subject to the following conditions: 1. Until completion of coordination, all operations are on a non- harmful interference basis, i. e. MTN shall neither cause nor claim protection from harmful interference. MTN shall cease operations immediately upon notification of harmful interference, and shall inform the Commission in writing immediately of such an event. 2. Any action taken or expense incurred as a result of operations pursuant to this waiver is solely at MTN’s own risk. 3. MTN shall complete coordination for each earth station at the earliest possible date, and shall submit a notification of such coordination in accordance with the Public Notice, DA 05- 1671 (released June 15, 2005).
