C. 20554 News Media Information 202 / 418- 0500 Internet: http:// www. fcc. gov TTY: 1- 888- 835- 5322 DA 05- 3073 November 28, 2005 WIRELINE COMPETITION BUREAU GRANTS MOTION FOR EXTENSION OF TIME TO FILE OPPOSITION TO REQUEST FOR STAY IN THE COMMUNICATIONS ASSISTANCE FOR LAW ENFORCEMENT ACT AND BROADBAND ACCESS AND SERVICES PROCEEDING ET DOCKET NO. 04- 295 On November 25, 2005, the United States Department of Justice (DOJ) filed a motion, pursuant to section 1.46( b) of the Commission’s rules, 1 to extend the deadline for responding to a pending request for stay of the Commission’s First Report and Order in the Communications Assistance for Law Enforcement Act and Broadband Access and Services proceeding. 2 DOJ seeks a two- day extension of the November 30, 2005 deadline for filing oppositions, to take into account that the seven- day period for responding to the request for stay includes the Thanksgiving holiday and the following Friday. Motions for extensions of time are not routinely granted. 3 Nevertheless, we do occasionally grant limited extensions of time when we find that the public interest would be served by doing so. In this case, we believe that granting DOJ’s motion is in the public interest. Given that the Thanksgiving holiday effectively shortened the normal time for responding to the request for stay, that the requested extension will not interfere with the Commission’s ability to respond to the request for stay, and that the parties who filed the request for stay do not oppose DOJ’s motion, we find that a modest extension of two days is appropriate. Parties therefore have until December 2, 2005 to file oppositions to the request for stay.
