C. 20554 News Media Information 202 / 418- 0500 Internet: http:// www. fcc. gov TTY: 1- 888- 835- 5322 DA 05- 3095 Released: November 29, 2005 MEDIA BUREAU REMINDS DIGITAL TELEVISION LICENSEES TO FILE REPORT ON ANCILLARY OR SUPPLEMENTARY DTV SERVICES ON OR BEFORE DECEMBER 1, 2005 Under Section 73.624( g) of the Commission's rules, commercial and noncommercial television licensees transmitting digitally must annually remit a fee of five percent of the gross revenues derived from all ancillary or supplementary services that are feeable, as defined by the rules. 47 C. F. R. § 73.624( g); 47 U. S. C. § 336( e). Section 73. 624( g)( 2) further requires that digital licensees file a report, no later than each December 1, stating whether or not they provided ancillary or supplementary services in the twelve months ending on the preceding September 30 and, if so, giving "( A) a brief description of the services provided; (B) which services were feeable ancillary or supplementary services; (C) whether any ancillary or supplementary services provided were not subject to a fee; (D) gross revenues received from all feeable ancillary and supplementary services provided during the applicable period; and (E) the amount of bitstream used to provide ancillary or supplementary services during the applicable period." The rule states that "[ f] ailure to file regardless of revenues from ancillary or supplementary services or provision of such services may result in appropriate sanctions.” 47 C. F. R. § 73.624( g)( 2) (emphasis added). Commercial and noncommercial DTV licensees that have provided feeable services must also file the standard remittance Form 159 certifying the amount of gross revenues received from feeable ancillary or supplementary services for the previous twelve months, ending September 30, 2005, and remitting payment of the required fee. Form 317 (November 2003 Edition) on which to make this report and remittance is available for filing by using the Media Bureau Consolidated Database System (CDBS) electronic filing. This system provides the public with the ability to fill out FCC Form 317 on- line via the Internet from the Media Bureau’s Web Site, http:// www. fcc. gov/ mb, and to file it electronically with the Commission. Internet access to the CDBS requires a user to have, at a minimum, a browser such as Netscape version 3.04 or Internet Explorer version 3.51. The Form 317 is also available through the Internet if you access the FCC’s Web Site at http:// www. fcc. gov and click on the Forms link. A copy of FCC Form 317 is attached to this Public Notice.
