File No. 698 Comments Due: February 22, 2005 Section 214 Application Applicant: Cincinnati Bell Telephone Company On February 1, 2005, Cincinnati Bell Telephone Company (Cincinnati Bell or Applicant), located at 201 East Fourth Street, Cincinnati, Ohio 45202, filed an application with the Federal Communications Commission (FCC or Commission) requesting authority to the extent necessary, under section 214 of the Communications Act of 1934, as amended, 47 U. S. C. § 214, and section 63.71 of the Commission’s rules, 47 C. F. R. § 63.71, to discontinue the provision of Electronic Listing Information (ELI) Service to customers in certain geographic areas. Cincinnati Bell indicates in its application that its ELI Service allows for direct on- line electronic access to Cincinnati Bell’s customer listing database via dial- up, without the assistance of an operator. Cincinnati Bell states that it proposes to discontinue this service as of March 22, 2005 due to provisioning issues regarding reliability and customer billing, and due to the very limited customer demand for this service. Cincinnati Bell further states that its Internet Directory Assistance Service provides the same functionality as ELI service via the Internet, and that this service is currently available as an alternative. The application indicates that the proposed discontinuance of ELI service will affect customers located in Florida, Georgia and Illinois. Cincinnati Bell states that it is non- dominant with respect to the ELI service to be discontinued, and that it notified all affected customers of the proposed discontinuance by letter dated January 28, 2005. In accordance with section 63.71( c) of the Commission’s rules, Cincinnati Bell’s application will be deemed to be granted automatically on the thirty- first (31st) day after the release date of this public notice, unless the Commission notifies Cincinnati Bell that the grant will not be automatically effective. In its application and notice to customers, Cincinnati Bell indicated that it plans to discontinue service as of March 22, 2005. Accordingly, pursuant to section 63.71( c), absent further Commission action, Cincinnati Bell may not terminate service until March 22, 2005. The Commission will normally authorize proposed discontinuances of service unless it is shown that customers or other end users would be unable to receive service or a reasonable substitute from another carrier, or that the public convenience and necessity would otherwise be adversely affected.
