Counsel for Spectrum Five LLC Wiley Rein & Fielding LLP 1776 K Street, NW Washington, D. C. 20006 Re: Spectrum Five LLC Petition for Declaratory Ruling, File No. SAT- LOI- 20041228- 00229, Call Sign S2650 Dear Mr. Stansbury: On February 17,2005, the Satellite Division dismissed without prejudice Application File No. SAT- LOI- 20041228- 00228 (Call Sign 2649). See Letter from Fern J. Jarmulnek to Todd M. Stansbury (Feb. l7,2005)( DA 05- 354). In the dismissal letter, the Division found that Spectrum Five LLC's petitions to serve the United States from two Spectrum Five satellites were defective. The Division, however, erroneously cited only one of the two petitions filed by Spectrum Five. For the same reasons addressed in the February 17, 2005 dismissal letter, we dismiss without prejudice to refiling Spectrum Five's petition for its second satellite, File No. SAT- LOI- 20041228- 00229, Call Sign S2650. Sincerely , Fern J. Jarmuhek Deputy Chief, Satellite Division cc: David Wilson President SPECTRUM FIVE LLC 626 S. 25th Street Arlington, VA 22202 1
