C. 20554 News Media Information 202 / 418- 0500 Internet: http:// www. fcc. gov TTY: 1- 888- 835- 5322 DA 05- 655 March 11, 2005 First Round DTV Channel Election Issues – List of In- Core Channels Elected by Out- of-Core Stations Participating in Proposed Negotiated Channel Arrangements; List of Stations That Submitted Schedule B Reflecting Reduced Operating Facilities in Connection with Proposed Negotiated Channel Arrangements The Media Bureau hereby releases a list of the DTV channels elected by stations with two out-of- core channels that are participating in proposed negotiated channel arrangements (NCAs), as indicated on FCC Form 382, Digital Channel Election Form First Round Election. This list is attached hereto as Table I. Because these stations have two out- of- core channels, they were not required or permitted to file a channel election in the first round of elections. However, the FCC Form 382 filings indicate that these stations are participating in a proposed NCA. If the NCA is approved by the Commission, these stations will receive a tentative channel designation in the first round of channel elections and will not be required to file a channel election form in the second round of elections (FCC Form 384, Digital Channel Election Form Second Round Election). To ensure that all interested parties have an opportunity to comment on the proposed NCAs for these stations, we hereby identify the channels these stations propose for post-transition DTV operation in connection with the NCA. Parties objecting to or commenting on an NCA in which the stations identified in Table I are participating must file their pleadings with the Commission no later than March 21, 2005, and replies must be filed no later than March 28, 2005. For these NCAs, these filing deadlines supersede those announced in our earlier Public Notice (DA 05- 519, released March 1, 2005). Pleadings must reference both the NCA application file number and docket number 03- 15 (the Media Bureau docket number of the Second DTV Periodic Review Proceeding) and must be filed electronically using the Commission’s Electronic Comment Filing System (“ ECFS”). A copy of any pleading regarding an NCA must also be served by express mail on all stations participating in the NCA. A copy of each pleading must also be delivered to Nazifa Sawez, Federal Communications Commission, Room 2- A726, 445 12 th Street, S. W., Washington, D. C. 20554. The Media Bureau also hereby releases a list of the stations that have filed Schedule B in connection with a proposed NCA that entails a reduction in station operating facilities. This list is attached hereto as Table II. 1 2 We remind stations that all NCAs are subject to Commission approval and may be rejected if they propose the acceptance of a significant level of interference or loss of service or are otherwise inconsistent with the public interest. If, after review of the record, including but not limited to oppositions and replies, we find that the NCA reasonably could be construed to have an adverse impact on the interests of a station not a party to the NCA, or is otherwise not in the public interest, the NCA will be rejected.
