C. 20554 News Media Information 202 / 418- 0500 Fax- On- Demand 202 / 418- 2830 TTY 202 / 418- 2555 Internet: http:// www. fcc. gov ftp. fcc. gov DA 05- 689 April 06, 2005 WIRELESS TELECOMMUNICATIONS BUREAU REMINDS APPLICANTS OF END OF WAIVER RELIEF AND BEGINNING OF AUTOMATED LETTERS FOR NOTIFICATIONS OF CONSUMMATION OF WIRELESS LICENSE ASSIGNMENT AND TRANSFER OF CONTROL APPLICATIONS The FCC’s Wireless Telecommunications Bureau (WTB) reminds applicants that, effective March 15, 2005 the 90- day waiver relief period for untimely notifications of consummation of wireless license assignment and transfer of control applications that began on December 15, 2004 ended, and the deadlines set forth in Section 1.948( d) of the Commission’s rules will be strictly enforced. 1 During this period, a total of 586 applicants took advantage of waiver relief. Automated Letter Notification The Wireless Telecommunications Bureau will begin sending automated reminder letters prior to upcoming consummation deadlines and application dismissal letters following lapsed consummation deadlines for assignment of authorization and transfer of control applications. Reminder letters will be sent approximately 45 days before the consummation deadline (the end of the 180 day period specified in Section 1.948( d)). The applicant will then have up until the date of the consummation deadline to submit a notification of consummation or a request for an extension of time to consummate to the FCC via ULS (http:// wireless. fcc. gov/ uls/) or manually when applicable. If the FCC does not receive either a notification of consummation or a request for an extension of time to consummate on or before the consummation deadline, the application will be dismissed and a dismissal letter will be sent to the parties involved with the application. No reminder letter will be sent if the consummation deadline of an application for assignment of authorization or transfer of control is on or before April 8, 2005. In this case, if the FCC has not received either a notification of consummation or a request for an extension of time to consummate by the consummation deadline, the application will be dismissed and a dismissal letter will be sent. Reminder and dismissal letters will be sent to all parties involved in the application. For an assignment of authorization these parties are the Assignor, Assignee, Assignor's Contact, and Assignee's Contact. For a transfer of control these parties are the Transferor, Transferee, Transferor’s Contact, and Transferee's Contact. Dismissed applications will be listed on a weekly action public notice on the ULS Weekly Status Public Notices page (http:// wireless. fcc. gov/ uls/ weeklypn. html). 1 See Federal Communications Commission Announces Waiver Relief for Untimely Notifications of Consummation of Wireless License Assignment and Transfer of Control Applications, Public Notice, 19 FCC Rcd 24549 (2004). 1 2 In cases where the applicants no longer intend to consummate an approved transaction, we encourage the applicants to withdraw the underlying assignment or transfer of control application in order to remove any uncertainty as to the status of the subject license( s).
