The Audio Division considers herein the Notice of Proposed Rule Making (“ Notice”) 1 issued at the request of MissAla RF (“ Petitioner”), requesting the allotment of Channel 278A at Frisco City, Alabama, as its first local aural transmission service. Petitioner did not file comments. Brantley Broadcast Associates (“ Brantley”) filed comments 2 expressing its interest in applying for Channel 278A at Frisco City, Alabama, if the Commission allots Channel 278A to that community. No counterproposals or other comments were received in this proceeding. 2. As stated in the Notice, Frisco City is an incorporated community with a population of 1,460 persons. We find that the public interest would be served by allotting Channel 278A at Frisco City, Alabama, as its first local aural transmission service. Consistent with the Commission’s technical requirements, Channel 278A can be allotted to Frisco City with a site restriction 13.7 kilometers (8.5 miles) west of Frisco City, using reference coordinates of 31- 27- 42 NL and 87- 32- 29 WL. 3. The Commission will send a copy of this Report and Order in a report to be sent to Congress and the Government Accountability Office pursuant to the Congressional Review Act, see 5 U. S. C. 801( a)( 1)( A). 4. Accordingly, pursuant to the authority found in 47 U. S. C. Sections 4( i), 5( c)( 1), 303( g) and (r) and 307( b) and 47 C. F. R. Sections 0.61, 0.204( b) and 0.283, IT IS ORDERED, That effective July 17, 2006, the FM Table of Allotments, 47 C. F. R. Section 73. 202( b), IS AMENDED, with respect to the communities listed below, to read as follows: Community Channel No. Frisco City, Alabama 278A 1 Frisco City, Alabama, Notice of Proposed Rule Making, 21 FCC Rcd 2237 (MB 2006). 2 Brantley’s comments were filed on the due date for reply comments. Brantley filed a Motion for Leave to File Late Comments along with its late filed Comments, noting that the Commission has accepted late filed Comments in other instances in which there was no adverse impact on any other proposal. The window period for filing applications for Channel 278A at Frisco City, Alabama, will not be opened at this time.
