The Audio Division issued a Notice of Proposed Rulemaking in response to a Petition for Rule Making filed by Charles Crawford (“ Crawford”). 1 The Notice proposes the allotment of Channel 288A at Odin, Illinois, as a first local FM service. Crawford filed comments supporting the allotment of Channel 288A at Odin, and reaffirmed his intention to apply for the channel if it is allotted and, if authorized, to build and operate a station on that channel. 2. A counterproposal was filed by Benjamin L. Stratemeyer (“ Stratemeyer”). Stratemeyer requests that the Commission allot Channel 288A as a first local service at Altamont, Illinois, in lieu of allotting that channel at Odin, as requested by Crawford and proposed in the Notice. Stratemeyer points out that Altamont, a town of 2,258 persons, is larger than Odin, a community of 1,122 persons 3. In evaluating mutually exclusive allotment proposals, we compare the proposed arrangements of allotments using the FM allotment priorities set forth in Revision of FM Assignment Policies and Procedures. 2 Although allotment at either community would satisfy the third allotment priority, first local service, we find that the larger population of Altamont supports the allotment of Channel 288A at Altamont rather than Odin. 1 Hennessey, Oklahoma, Odin, Illinois, and Spur, Texas, Notice of Proposed Rule Making, 20 FCC Rcd 4331 (MB 2005) (“ Notice”). 2 See Revision of FM Assignment Policies and Procedures, Second Report and Order, 90 FCC 2d 88 (1982), recon. denied, Memorandum Opinion and Order, 56 RR 2d 448 (1983). The FM allotment priorities are: (1) first full- time aural service; (2) second full- time aural service; (3) first local service; and (4) other public interest matters. For the foregoing reasons, we find that the public interest would be served by the allotment of Channel 288A at Altamont, Illinois, as a first local service. Channel 288A can be allotted with a site restriction of 6.2 kilometers (3.9 miles) southwest of Altamont, at the following reference coordinates: 39- 01- 44 North Latitude and 88- 48- 22 West Longitude. 5. The Commission will send a copy of this Report and Order in a report to be sent to Congress and the Government Accountability Office pursuant to the Congressional Review Act. 3 6. Accordingly, IT IS ORDERED, That effective August 7, 2006, the FM Table of Allotments, 47 C. F. R. Section 73.202( b), IS AMENDED as follows: Community Channel Number Altamont, Illinois 288A 7. IT IS FURTHER ORDERED, That the proposed allotment of Channel 288A at Odin, Illinois, is DENIED. 8.
