C. 20554 News Media Information 202 / 418- 0500 Internet: http:// www. fcc. gov TTY: 1- 888- 835- 5322 DA 06- 1434 Released: July 11, 2006 COMMENTS SOUGHT ON VERIZON PETITION FOR WAIVER TO TREAT CERTAIN LOCAL NUMBER PORTABILITY COSTS AS EXOGENOUS COSTS CC Docket No. 95- 116 COMMENTS DUE: July 21, 2006 REPLY COMMENTS DUE: July 25, 2006 On July 6, 2006, Verizon filed a petition requesting that the Commission “waive certain rules in order to permit Verizon the opportunity to recover the remainder of its approved carrier- specific costs for implementing local number portability (“ LNP”).” 1 Specifically, Verizon seeks authority to treat these costs as exogenous costs under section 61.45( d) of the Commission’s rules “and to recover those costs through a small addition to its end- user common line charge (“ EUCL”).” 2 Verizon asserts that it satisfies the Commission’s standard for exogenous cost relief “because the unrecovered LNP costs are the result of a government mandate, were beyond Verizon’s control, and are not accounted for in Verizon’s price cap formula.” 3 We note that AT& T Inc. (AT& T) filed a petition seeking similar relief on March 31, 2006, and an order granting the petition was released on July 10, 2006. 4 Verizon asserts that “AT& T and Verizon are similarly situated with respect to under- recovery of their respective LNP cost estimates” and that there is good cause for a waiver because unforeseeable and unprecedented changes in the telecommunications marketplace prevented Verizon from a full reasonable recovery of its LNP costs. 5 Interested parties may file comments on or before July 21, 2006, and reply comments on or before July 25, 2006.
