C. § 160( c) FROM TITLE II AND COMPUTER INQUIRY RULES WITH RESPECT TO BROADBAND SERVICES WC Docket No. 06- 125 Comments Due: August 3, 2006 Reply Comments Due: August 18, 2006 On July 20, 2006, BellSouth Corporation (BellSouth) filed a petition for forbearance pursuant to section 10( c) of the Communications Act of 1934, as amended (the Act), 47 U. S. C. § 160( c). In its petition, BellSouth asks the Commission to grant BellSouth and similarly situated carriers forbearance from Title II and the Computer Inquiry rules to certain specified broadband services. 1 This Public Notice establishes certain procedural requirements relating to consideration of the BellSouth petition for forbearance. This matter shall be treated as a “permit- but- disclose” proceeding in accordance with the Commission’s ex parte rules. See 47 C. F. R. §§ 1.1200, 1.1206. Persons making oral ex parte presentations are reminded that memoranda summarizing the presentations must contain summaries of the substance of the presentations and not merely a listing of the subjects discussed. More than a one or two sentence description of the views and arguments presented generally is required. See 47 C. F. R. § 1.1206( b). Other rules pertaining to oral and written ex parte presentations in permit- but- disclose proceedings are set forth in Section 1 Petition of BellSouth Corporation for Forbearance Under 47 U. S. C. § 160( c) from Title II and Computer Inquiry Rules with Respect to Its Broadband Services, WC Docket 06- 125 (July 20, 2006). Attachment A to BellSouth’s petition lists these broadband services. We note that Qwest and AT& T have also filed petitions for forbearance seeking similar relief. See Pleading Cycle Established for Comments on Qwest and AT& T Petitions for Forbearance Under 47 U. S. C. § 160( c) from Title II and Computer Inquiry Rules with Respect to Broadband Services, WC Docket No. 06- 125, Public Notice, DA 06- 1464 (rel. July 19, 2006). The Qwest, AT& T, and BellSouth forbearance petitions have identical comment and reply comment dates and are filed in the same WC Docket No. 06- 125. Accordingly, we ask each party commenting on two or more of these petitions to combine its comments into one filing. 1
