Under Section 1.1203 of the Commission’s rules, presentations to decision makers are generally prohibited during the “sunshine period,” which ran in this proceeding from June 14, 2006, when the Commission issued a Public Notice that the matter had been placed on the agenda for the Commission’s June 21, 2006 Open Meeting, until July 24, 2006, when the Further Notice was released. Nonetheless, the Commission received numerous public comments in this proceeding after adoption of the Further Notice at the Commission’s June 21, 2006 meeting and prior to its release. The Bureau, acting by delegated authority, finds that it would serve the public interest to waive the sunshine prohibition with respect to these comments filed after the adoption date of the Further Notice, in the interests of facilitating public comment and thereby assembling a full record on the issues in this proceeding. Accordingly, all written comments filed in this proceeding (MB Docket Nos. 06- 121 et al.) after June 21, 2006 and during the sunshine period will be accepted and included in the record of this proceeding.
